Chapter one: Iḥrām

It is the first obligation of hajj and the same as that of ‘umrah regarding conditions, manner, kaffārahs, rules and prohibited things during it. It differs only in intention, i.e. one should intend to perform the practices of hajj. All things considered in the intention of ihÌ£rām for ‘umrah would be observed here as well. IhÌ£rām would be achieved by intention and talibyah, then if one intended hajj and did talbiyah, one's ihÌ£rām would be achieved.

However, iḥrām of hajj has some peculiarities which will be mentioned in the following issues:
Issue 324. The mÄ«qāt of ihÌ£rām for hajj al-tamattu‘ is Mecca al-mukarramah and it is better that it be done in the Masjid al-HÌ£arām. It is valid, also, to do ihÌ£rām at any place in Mecca even the new ones, although caution prefers it be done in the old places. However, if one is in doubt whether this place is within Mecca or not, it is incorrect to do ihÌ£rām from this place.
Issue 325. It is obligatory to do ihÌ£rām before shar‘Ä« noon on the 9th of Dhul-Hijjah to attend the normal wuqÅ«f of ‘Arafāt, and the best time for ihÌ£rām is at the shar‘Ä« noon on the 8th of Dhul-Hijjah (the day of tarwiyah). It is permissible to do ihÌ£rām before that time especially for the old and sick if they are afraid of crowdedness. It had been mentioned that ihÌ£rām for hajj could be advanced for those who want to get out of Mecca for some purposes after performing the ‘umrah.
Issue 326. One, who forgets ihÌ£rām and set off for ‘Arafāt, is obliged to go back to Mecca and do ihÌ£rām. If this is impossible because of time limitations or due to another excuse, one can do ihÌ£rām at his / her place and hajj would be correct. Apparently ignorance is considered to have the same ruling as forgeting.
Issue 327. If one forgot iḥrām until he / she finished the hajj rituals, hajj would be correct. Ignorance of the ruling will be considered just like forgeting. However, it is based on mustaḥabb caution to repeat the hajj the next year, in both cases of ignorance and forgeting.
Issue 328. One who, consciously and deliberately, had neglected ihÌ£rām until they could not attain wuqÅ«f at ‘Arafāt and Mash‘ar, their hajj is void.
Issue 329. One, who is allowed to advance the rituals of Mecca before the two wuqūfs, is obliged to perform them with iḥrām. In case one had done them without it, he / she must repeat them with iḥrām.
